On February 15, 2002, Ocean Express filed with the U.S. Minerals Management Service (MMS) its Application for a Natural Gas Pipeline Right-of-Way on the Outer Continental Shelf (OCS) off the coast of Broward County, Florida. A pipeline right-of-way granted by the MMS is required for the portion of the Ocean Express’ route—approximately 48.03 statute miles—traversing federal waters. Ocean Express’ Application to the MMS contained the numerous data, information and fees required by Section 1334(e) of the Outer Continental Shelf Lands Act, 43 U.S.C. § 1134(e), and the MMS’ implementing regulations under 30 C.F.R. Part 250, Subpart J. Ocean Express also submitted information to the MMS to establish its qualifications to hold a right-of-way on the OCS.

Ocean Express anticipates that the MMS and FERC will cooperate with each other in analyzing the applications filed at the respective agencies, including, for example, joint preparation of an Environmental Impact Statement analyzing any environmental impacts associated with the Ocean Express project.

On October 18, 2002, and September 9, 2004, Ocean Express filed with FERC Amendments to its Application for Certificates of Public Convenience and Necessity for the Ocean Express Pipeline. The Amendments reflect a proposed route variation, as well as construction and design changes for the nearshore portion of Ocean Express' offshore pipeline. The October 18, 2002 Amendment contained certain pipeline design and materials modifications that address potential technical and operational concerns of the Naval Surface Warfare Center, Carderock Division, regarding an offshore segment of the original pipeline route. On November 27, 2002, and in November 2004, Ocean Express filed with the Minerals Management Service an Amendment to its Application for Right-of-Way Authorization on the Outer Continental Shelf. The amended MMS applications addressed the proposed route variation, as well as construction and design changes for the nearshore portion of Ocean Express' offshore pipeline.
